Y.Y. was riding on the Tomahawk Face trail when the defendant approached from uphill. As the defendant attempted to pass from above, he lost control and collided into Y.Y. at a high rate of speed. Under Colorado law, uphill riders have the primary duty to avoid those below.<\/p>\n\n\n\n
As a result of the crash, our client suffered serious injuries, including a left orbital floor fracture that had to be surgically repaired and a nondisplaced fracture of her left tibia.<\/p>\n\n\n\n
